U.S. Department of Labor Issues Proposed Rule Increasing Minimum Wage for Certain Federal Contractors
On July 22, 2021, the U.S. Department of Labor (DOL) published a Notice of Proposed Rulemaking (NPRM) implementing President Biden’s April 27, 2021, Executive Order 14026 “Increasing the Minimum Wage for Federal Contractors,” which increases the minimum wage for employees of certain federal contractors to $15 per hour (and to $10.50 per hour for tipped employees) effective January 30, 2022. The executive order goes into effect on January 30, 2022, and includes several significant expansions of the Obama-era Executive Order 13658 on which it is based. The executive order does not cover employers who are not federal contractors and only covers federal contractors who have certain categories of federal contracts.

FDA Issues Final Guidance on Form and Content of Unique Device Identifier Labeling System
On July 7, 2021, the U.S. Food and Drug Administration (FDA) issued a final guidance regarding the form and content of unique device identifier (UDI) labeling. The guidance will assist labelers of medical devices and FDA-accredited issuing agencies (who operate systems for issuing UDIs used by labelers) in meeting the requirements under 21 CFR Part 801, Subpart B, and the Unique Device Identification System Final Rule, 78 FR 58786 (September 24, 2013) (UDI Rule).

Third Circuit Upholds National Labor Relations Board's Return to Pre-Obama Deferral Standard
On July 8, 2021, the United States Court of Appeals for the Third Circuit issued an opinion upholding the National Labor Relations Board’s 2019 decision relating to post-arbitral deferral standards. The Third Circuit found that the Board’s decision to eliminate an Obama-era rule and return to the standard that had been in effect for decades prior was rational and consistent with the National Labor Relations Act (the “Act”).
