Merger control: Commission approves proposedventure between joint Energinet, E.ON Netz, Vattenfall Transmission, Nord Pool and EEX on cross-border power transmission management

The Commission has approved the creation of European Market Coupling Company (“EMCC”), a joint venture between three transmission system operators – Energinet.dk (“Energinet”), of Denmark, E.ON Netz GmbH (“E.ON”), of Germany, Vattenfall Europe Transmission GmbH (“Vattenfall”), of Germany – and two energy exchanges – Nord Pool Spot AS (“Nord Pool”), of Norway, and European Energy Exchange AG (“EEX”), of Germany. EMCC will be active in providing congestion management services for cross-border electricity transmission systems through market coupling between Germany and the Nordic Countries and will provide a platform for secondary trading of transmission rights. EMCC was created to implement Regulation (EC) No 1228/2003 on conditions for access to the network for cross-border exchanges in electricity. The Commission concluded that the proposed joint venture will not create or strengthen such a dominant market position that would significantly impede effective competition in the EEA or in any substantial part thereof.
